Forming a PLLC in New York

The process for creating most professional LLCs (called PLLCs) or professional corporations (PCs) in New York is very different than it is for a regular entity.

 

 

For most types of professional practices, the formation process takes considerably longer due to the extra steps required, which are described below. It is also a bit more expensive due to the required extra paperwork.

 

 

The reason for the extra delay and expense is the required preapproval process. Before most professional entities can be set up, they must obtain preapproval from the NYS Education Dept. (NYSED), which adds about another 3-4 months to the process. Sadly, there is no way around this frustrating requirement. This is not unique to us, this is a function of the state. Anyone who tells you they can do it faster is misleading you into spending your money with them.

 

 

ANY SMALL ERRORS, NAMING MISTAKES, OR OTHER MISSTEPS IN THE PREAPPROVAL REQUEST WILL RESULT IN AN EVEN LONGER WAIT FOR APPROVAL (IT COULD ADD SEVERAL MORE MONTHS!).
